Section: 1464_1 - 1470

Section 1464/1.- During the judicial proceedings on compliance with Section 1464, if there is the motion, the temporary process concerning the maintenance or the protection of the insane spouse as being deemed suitable shall be determined by the Court, and in the case of emergency, the provisions relating to the request in case of emergency under the Civil Procedure code shall be applied.

 

CHAPTER IV

PROPERTY OF HUSBAND AND WIFE

 

Section 1465.- If previous to their marriage, the husband and the wife have not made a special agreement concerning their properties, the relations between them as to their properties shall be governed by the provisions of this Chapter.

If a statement in the ante-nuptial agreement is in contravention of the public peace or public good morals, or specified that such properties are to be governed by foreign law, the statement is void.

 

Section 1466.- The ante-nuptial agreement is void, if the agreement being not notified as the ante-nuptial agreement in Marriage Register with Marriage Registration, or if the agreement being not made in writing and signed by both spouses and by at least two witnesses and the agreement being notified in the Marriage Register with Marriage Registration that the ante-nuptial agreement is thereto annexed.

 

Section 1467.- When the marriage being made, the ante-nuptial agreement cannot be revoked, except with the permission of the Court.

When the Court has had the final order to effect the alteration of revocation of the ante-nuptial agreement, the Court shall notify such matter to the Marriage Registrar in order to have it notified in the Marriage Register.

 

Section 1468.- The statement in the ante-nuptial agreement cannot affect the rights of the third person acting in good faith irrespective of whether being altered or cancelled by the order of the Court.

 

Section 1469.- The contract, in respect of a property having been made between the husband and the wife during being spouses, can be revoked by either of the spouses at any time during being spouses or within one year as from the day of dissolution of being spouses, but it shall affect the right of the third person acting in good faith.

 

Section 1470.- The properties between the husband and the wife, except to be disjoined as Personal Effects, are the Marriage Portion.
