American Amity Treaty Companies In Thailand?

Transcript of the above video:

I thought I would go ahead and make kind of a roundup video, just maybe a review video is the right word, talking about what are called Amity Treaty Companies here in Thailand.  I had a few inquiries recently. It looks to me like some of the folks that are now currently moving to Thailand are not as aware, especially Americans, are not aware of some of the rules and benefits that may come from just having American citizenship and wanting to do business here in Thailand.

For those who are unaware, yeah it is possible for Americans to own their companies out right pursuant to the provisions of what's called the US-Thai Treaty of Amity. Under the provisions of that Treaty, Americans and American businesses are afforded the opportunity to do business in Thailand with what's called "National Treatment", i.e. they be treated in the same way as a Thai National would be treated when trying to do business here in the Kingdom.

So the thing to take away from this video and to understand is yes if an American Company is certified pursuant to the US-Thai Treaty of Amity it is possible to own that company out right and it is possible to do that notwithstanding the fact that the Foreign Business Act here in Thailand would require that such companies generally speaking are 49/51 American, or foreign to Thai owned under usual circumstances. So generally speaking, most nationalities looking to do business here in Thailand are going to have to structure their companies under a 49/51 sort of arrangement unless they have other types of concessions that may apply to the company. But those who are looking to do business as Americans here in Thailand pursuant to the Treaty, it is possible to own that company 100%. So again, that is something that I do think some Americans overlook when trying to establish a company here in the Kingdom of Thailand.
