Can Thai Amity Treaty Companies Engage in Cannabis Business?

As the title of this video suggests, we are asking “can Amity Companies engage in the Cannabis Industry?” As I have discussed in other videos on this channel, the Thai Cannabis Business is very new; it has come about only about a year ago when Cannabis was pulled off of the narcotics list here in Thailand and now Cannabis is effectively legal. Now that said, there are there is a regulatory structure, albeit a rather simplistic one in place at the moment. Those engaging in that industry have to get licensed, a Controlled Herb License. As of the time of this video, it may be possible to do that although leading in to the opening of Parliament it seems logical to presume that this is probably going to get more cumbersome as time goes by. 

However, the point of this video is can Amity Treaty Companies engage in the Cannabis trade, or in Cannabis Businesses? Based on my understanding of the Treaty, my reading of it and my experience in dealing with it over the past 15 years, my opinion is NO, Cannabis is not going to be covered under Amity most notably because at the end of the day it is an agricultural product and anything that has to do with it is operating in an agricultural capacity. Now that said, businesses and sort of business activity that maybe ancillary to the Cannabis trade and Cannabis farming etc., that may be a different kettle of fish if you will. 

That said, and the thing to take away from this video is again this is all circumstantially dependent. So those who are looking at engaging in this activity, it is probably a good idea to contact a legal professional, gain some insight and guidance into how best to proceed.
