"Certain Law Firms" "Nominee Factories" in Thailand?
Transcript of the above video:
As the title of this video suggests, we are discussing, well we're discussing certain “law firms" as nominee factories in Thailand. I thought of making this video after reading a recent article from the Pattaya Mail, that is pattayamail.com, the article is titled: When high-stakes deals in EEC are shaken by "sworn declarations". Quoting directly:
"When law firms become "Nominee Factories" Quoting directly:
During the investigations in Chonburi and Rayong, authorities uncovered a disturbing trend that goes far beyond hiring office staff to hold shares. It was found that "certain law firms" have become the primary drivers of these criminal networks." Quoting further:
"Signature Forgery - Investigators found registration documents where Thai nationals' signatures were forged to obtain legal rights for entities. In many cases, these individuals were unaware their names were being used, or were misled into signing blank documents." Quoting further:
"Professional Betrayal - This reflects a dark reality where some legal advisors are not acting as shields of the law, but as architects of its destruction, compromising national security databases for lucrative "service fees".
Well and more to the point - as I have discussed in other videos - we have got a bunch of fake lawyers out there. And on top of that, foreign nationals shouldn't even be involved in the Thai Legal profession to begin with. As I have discussed, it's a restricted occupation in Thailand; it always has. Foreign nationals operating in Thailand, dealing with things pertaining to Thai Law, it's very clear; I put it up on screen in many situations before. But as the author of this article is pointing out, we are seeing a situation where folks who are not acting in good faith within what could be described as the legal profession although I hesitate to use that term for somebody who's operating fraudulently that way, especially again, as it pertains to a foreign national or just a complete fake lawyer which unfortunately Thailand has that as well as I have gotten into in other videos. But long story short, now they are acting, it seems like that some of these operators are acting as sort of "nominee factories" which in a sense, from the law enforcement perspective it's like a metastasizing cancer. They are causing more problems for the overall economy and in a law enforcement sense.
And for that reason I think this is why we have had this major paradigm shift here in Thailand away from the notion that Corporate Regulatory Compliance is purely an administrative matter to now as being a law enforcement matter, and one that they are taking seriously. As discussed in prior (correction) videos, there are hundreds of firms that are being affected by this, hundreds of corporate entities that are being affected by this, because Thai Law Enforcement is not messing around.
It remains to be seen how all of this plays out, but we will certainly be keeping folks updated on this channel as this situation evolves.
