Consequences of Employing a Foreigner Illegally in Thailand?

As the title of this video suggests, we are discussing illegally employing foreigners in Thailand. Now I want to be clear, this is different than being a foreigner and working illegally. Being a foreigner and working illegally brings its own set of problems but very few folks recognize that employing a foreigner illegally too, also has legal liabilities associated with it. 

I thought of making this video after reading a recent article from The Phuket Express, that is thephuketexpress.com, the article is titled: Ukrainian arrested for illegally working on Pha Ngan Island. Quoting directly: "A Ukrainian man was arrested for allegedly illegally working for a motorbike rental operator on Pha Ngan Island." I made another video contemporaneously with this one where we discussed that in more detail but this is key for this video. Quoting directly: "He was taken to Koh Pha Ngan Police Station and charged with parking at a non-parking area and working without a Work Permit. The motorbike rental company is facing the charge of employing a foreigner at the company without a Work Permit." So there is not only liability for a foreign national working in Thailand illegally, but the employer can face legal sanction as well in the form of both fines and possible criminal liability. We discussed this going back a while ago when we discussed human trafficking in the context of migrant workers, that folks that facilitated that could find themselves in real hot water, real criminal trouble, because they are effectively facilitating and transporting etc. folks who are working illegally. It is not dissimilar to the situation at hand here wherein the business that was allegedly employing this person illegally may ultimately face sanction as well. 

So the thing to take away from this video both as an employer and an employee, it is a far better thing to do to go ahead and get one's Work Permit sorted out rather than deal with the negative consequences that can arise from trying to circumvent the system.
