Do I Need a New Thai Work Permit If I Change Jobs?

As the title of this video suggests, we are discussing changing jobs and Work Permits associated therewith. In a sense this is about a Work Permit transfer but you have to understand, the regime on changing Work Permits went through a transition back in 2018. There was an Emergency Decree which altered some of the fundamentals associated with Thai Work Permits.

In the past when we would see Work Permits change, what you would often times see is what is called a cross endorsement. You would have a person who was on Work Permit for Company A, they want to move to Company B. As long as Company A was okay with the transition you would for one month usually, Company B would be a Co-employer and then Company A would move off. That has effectively ended. These Work Permits now, you have to affirmatively cancel for one Company and then affirmatively get on to the new Company. This can be a bit of an issue and it can be a sticky wicket, a little bit nettlesome. I think that the system wanted to see people depart and then come back in to reuptake their status if you will and they didn't really love seeing people transition in country. 

Under the COVID situation where it is really difficult to come and go, they seem to be making more accommodation for this kind of transition. That said, it is complex. There are a lot of moving parts with a Work Permit transition. Those that are looking to do that, it is probably a good idea to contact a legal professional to gain some insight and guidance into how best to proceed.
