As the title of this video suggests, we are discussing the fact that look, I have done a number of videos in the last six or eight weeks; there is a heavy crackdown going on regarding nominee companies here in Thailand. Specifically it's focusing at least at this time, on matters pertaining to corporations that own property. Specifically they are looking at whether or not these structures have been specifically engineered and designed for a foreigner to effectively "own", and I put that in quotes because it is restricted, property through a colour of law structure that allows them to effectively control an underlying piece of property; that seems to what's being the focus right now. I don't want to get into the nuts and bolts of that I've done a number of videos on the enforcement of that. People who this pertains to are well aware of it, so I don't want to get into that further.

The point of this video is to bring up the fact that yes, there may be solutions, there may be ways to rectify one's corporate situation. I put "fixing" in quotation marks because I want this to be viewed for what it is, or at least this video and the type of services we provide. This is not another work around; this is not some way of, “oh, we are going to “fix” it so that you can continue to operate illegally", that's not the point, but there may be ways to rectify either a corporate structure or if it's landownership within a corporate structure, there may be ways to make it so it's in line with Thai Law, so that someone or person or a business, whatever, can continue to utilize that property without being in violation of Thai Law. Now that said, the thing to take away from this video first off, especially for those who are really panicking right now because of all of this crackdown, take a deep breath; haste makes waste if you will. Moving too quickly and doing things in a haphazard manner out of panic from this going on is probably not going to help anything. If anything, it might red flag you in the system if you do something that radically alters the corporate structure and that could actually lead to more attention rather than less, while someone is trying to rectify the overall situation.

The point I am trying to make with this video is that again, as I say, I know I sound like a broken record but it's true, the underlying facts in the given case will drive the analysis as to how best to rectify a situation involving a corporation and possible underlying property ownership or sort of work authorization issues etc. Again, the underlying facts will drive that analysis, but it may be best under current circumstances to contact a legal professional, gain some insight and guidance into how best to proceed.
