Foreigner's Passing Shines Light On Thai Law?

As the title of this video suggests, we are discussing the passing of a foreign woman here in Thailand. It has been pretty big news because the upshot was her maid basically inherited a great deal of money but now there's some legal disputes involving this because of so-called nominee issues etc. 

I thought of making this video after reading a really insightful article from Khao Sod English, khaosodenglish.com, I urge those who are watching this video go check out that article in detail. Quoting directly: "French woman's Will to her housekeeper highlights Thai Business Law issues. Quoting directly: "The French woman's intention to leave her inheritance to someone she trusted seems to be difficult in practice unless there is cooperation from the Thais who hold shares in Madame Catherine's company." So again, I urge those who are watching this video go check out that article in detail. But what are we talking about here? What we're talking about, a nominee structure was apparently set up and the result is that the person that the deceased wanted their inheritance to move to, wanted their inheritance conveyed to is now having to go through a lot of obstacles because of quite honestly the shoddy legal structure that was set up in her favour. And by in her favour, I say that almost tongue in cheek or sarcastically, because at the end of the day it really wasn't in her favour. As I have discussed in other videos, it was more or less a colour of law set up that really doesn't do what she thinks it can do or thought it could do and we are now seeing the upshot of that proceedings associated with what the Thais call Succession or Probate as we call in the Common Law vernacular here in Thailand.

So the thing to take away from this video, when you are talking about estate planning, we are not only talking about Wills, setting up, drafting a proper Will, formalizing that correctly, we are also talking about estate planning; there could be Corporate Law implications, Property Law implications depending on one's assets here in Thailand, you need to assiduously make sure that your estate is in line with relevant Thai Law.
