Heightened Thai Government Scrutiny and BOI Certification
Transcript of the above video:
As the title of this video suggests, we are discussing the BOI, that is the Board of Investment. The Board of Investment is able to go ahead and grant concessions to foreign owned businesses, even Thai businesses if they fall within sort of the bailiwick of the types of business that the Thai Government, specifically the BOI itself is trying to promote in Thailand. This leads to a sort of, I hesitate to make this sound particularly snarky or something but kind of a flavour of the month type of paradigm with regard to BOI Certification. What I mean to say is, as time has gone on and I have been here 15 years, there have been different types of businesses that seem to be sort of en vogue with regard to BOI concessions. Now that is not to say that certain categories just fall by the wayside. There are a number of categories that someone can go ahead and obtain BOI concessions under, business categories specifically so when I say business category I mean area in which a given enterprise is doing business.
Now as the title of this video suggests, we are discussing the possibility of kind of heightened scrutiny. Is the Government going to scrutinize these enterprises more because they have BOI Certification? The fact of the matter is depending on the types of concessions especially where it comes to tax concessions as well as certain labour concessions as well, yeah the BOI is going to have like an increasing if you will, scrutiny associated with that. They are going to want to go ahead and make sure that that business continues to operate within the parameters for which they were granted the BOI concession. Now that is not to say a business can't engage in other business activities but if they are engaging in certain business activities and they are engaging in them under certain concessions for example a tax holiday or concessions associated with labour permits, this type of thing, BOI wants to know about and they kind of keep up on it. So yeah I would say in a certain way there is a heightened scrutiny from the Government associated with BOI Certification.
