"More Than 150 Companies" Targeted in Latest Thai Nominee Investigation?
Transcript of the above video:
As the title of this video suggests, we are discussing yet again the ongoing initiative by Thai Law Enforcement to ascertain whether or not corporations here in Thailand are in fact sort of front companies, if they are in fact nominee structures being set up for foreign nationals to operate illegally in Thailand.
The focus seems to be primarily upon companies that are land holding companies but that is not the sole target, the sole focal point if you will of these investigations, as certain aspects of restricted occupations and certain types of foreign businesses that are specifically restricted under the Foreign Business Act are also being targeted as well.
Before I jump in, really quickly I've received correspondence over the past months and folks have said, "Hey we know you're not monetized on this channel. We don't necessarily need to avail ourselves of a law firm at this time. Is there anything we can do to support you?" As I have pointed out, my better half and I set up a restaurant here in downtown Bangkok. The name is Pancake Palace, as the name implies it is breakfast anytime as well as American Diner style food. Basically we have got not only American breakfast food, we've also got a British or an English breakfast on the menu, and we've got hamburgers, cheeseburgers, chicken wings, buffalo wings, hot dogs, chilli dogs; we've got grilled cheese sandwiches, chilli bowls. We have also got Coke in glass bottles. If you are interested, links are in the description below; check that out and come down and see us.
That said, jumping in after reading a recent post on facebook.com, the Nation Thailand's posting on facebook.com, quoting directly: "Thai Authorities have searched five targets linked to property, hotel and wellness businesses as part of an investigation into 34 companies suspected of using Thai nominee shareholders. A law firm connected to more than 150 companies is a key focus of the investigation. Its address was also registered as the head office of more than 103 legal entities. Other targets include Chinese and Israeli linked businesses holding land and assets." That's key, "holding land and assets". The land holding component of this is the most important in the Thai paradigm. I think that's important to point out. As we discussed in other videos, this has even raised to the level now where it's considered a national security issue. The Army has gotten involved, but again land holding seems to be the most acutely problematic issue for law enforcement as of the time of this video. Quoting further: "Businesses holding land and assets worth hundreds of millions of baht. Officials are examining investment funds, management control and whether Thai shareholders were genuine investments."
Again, I have discussed this; there's some anecdotal evidence at the moment as well. Hua Hin now seems to be being targeted by this investigation. Again, as I have discussed in other videos, this is a nationwide endeavour, but different localities are seeing local law enforcement dealing with this in different ways albeit I would say that across the board, law enforcement here in Thailand is quite proactive on this matter. It remains to be seen exactly how this plays out, so we will certainly be keeping folks updated on this channel as the situation evolves.
