Non-Compete Agreements in Thailand

As the title of this video suggests, we are discussing Non-compete Agreements in Thailand. What are we talking about with respect to Non-compete Agreements? Well we are talking about what I would call Covenants Not to Compete. It is basically oftentimes as part of an employment contract you will have a provision in there that says "hey so and so cannot do the same type of business activity that they are doing for us within a certain interval of time, and oftentimes within a certain geographic radius of where we operate." 

Now I am not going to get too in-depth here because a lot of this is going to be fact driven. Also, it is a good idea to have a Thai Attorney go ahead and draft this in line with Thai Law. I am an American Attorney, I am a naturalized Thai citizen, I am the Managing Director of the firm but our Thai Attorneys are the ones that run point and handle matters involving the drafting of Non-compete Agreements in Thailand so as to comport with all relevant Thai Law wherever possible. But understand there are limits on Non-compete agreements. It is not possible to say "Hey you worked for us for 6 months. You are a video editor for example, you can never edit a video in the Kingdom of Thailand again." That is probably not going to be possible but there are reasonable Non-compete Agreements associated with employment contracts. Again it is probably a good idea to contact a legal professional, gain some insight and guidance into how best to draft such a document and enforce it should it come to that end.
