Obtaining an Amity Treaty Certificate for a Thai Company

Transcript of the above video:

As the title of this video suggests, we are discussing Amity Treaty Certificates. We are specifically discussing Amity Treaty Certificates, we are not talking about the process. I have done a number of videos on this channel describing the US-Thai Treaty of Amity and how it can provide benefits to people, specifically Americans looking to do business here in Thailand.

Long story short, notwithstanding the provisions of the Thai Foreign Business Act, an American or an American Company can do business in Thailand provided they meet the formalities associated with proving they are indeed an American Company, they can do business in Thailand notwithstanding the Foreign Business Act so they can own their company virtually 100% even though there are prohibitions against that under the Foreign Business Act. They can do that, provided they go through the motions and get the thing certified as in fact being an American Company. They are then granted National Treatment under the provisions of the Treaty.

The point of this video regards the Certificate itself which is really important. You have got to go through the process and then you have got to go ahead and get the Certificate. The Certificate itself is kind of expensive as far as just a piece of paper goes but it confers a great deal of benefit to the corporation which is certified. So while the Certificate itself might not seem like much, the benefits conferred i.e. National Treatment under the Treaty, are substantial.

For this reason, in my opinion even though there may be a high cost associated with just getting that Certificate, the cost in many ways is really sort of value for money.
