Tax, Residency, Citizenship, and US-Thai Amity Treaty Companies?
Transcript of the above video:
I thought I would make a video; well Cobra Gold is currently ongoing here in Thailand. That's a joint exercise between the United States and Thailand. It goes back a long ways and it shows the sort of military relationship between the two countries but in light of that, I thought I would make a video on the US-Thai Treaty of Amity. Haven't really gone over this or made a video on this, haven't made a video on this in a while.
For those who are unaware, the United States has a 191-year relationship diplomatically with the Thais. That's a Treaty relationship; it's over 200 years in terms of communication. The US-Thai Treaty of Amity is really special in many, many ways. It provides benefits that Americans get here that basically no other nationality gets or at least they don't get it in the same way; not via a Bilateral Treaty, but through discretionary measures like concessions from the Board of Investment for example or the Eastern Economic Corridor, whereas the Treaty provides what is called National Treatment to Americans doing business here in Thailand provided they get certified as Americans doing business, so that means an American company. And those companies can have 100% American shareholders notwithstanding the provisions of the Foreign Business Act. This is a major benefit. Americans can own their companies outright in Thailand; they don't necessarily have to do a 49/51 set up. The reason for this video though is to talk about a couple of other things.
I have discussed at length in other videos that there are in my opinion very anomalous, unique and highly beneficial tax implications to US-Thai Treaty of Amity Companies most notably because they basically amount to domestic non-resident corporations of the United States and thereby basically are sort of tax inert from any analysis from the American side. I have discussed this at link another videos - written briefs on it - check the links in the description below, you can see information about that. So they are unique from a tax perspective, but more than that just from some personal experience, an Amity Treaty Company, if you are really doing business in Thailand, can be used to put you on the path toward Permanent Residency here in Thailand and even possibly citizenship. And if you don't believe that, the proof is in the pudding; I'm standing right here. I founded this firm as an Amity Treaty Corporation and I've been here nearly 20 years, and I ran the gauntlet through all the Immigration matters to eventually culminate in becoming Thai.
So again, those who are looking to do business over here and also put down significant roots and also might want to find certain benefits from a tax perspective, if you are an American looking anywhere other than the Amity Treaty at least from the beginning, that may only be your jumping off point - in your specific set a circumstances some other type of structure may be more beneficial - but if you are not at least looking at The Amity Treaty, then you're being remiss in doing your due diligence on doing business here in the Kingdom of Thailand.
