Thai Board of Investment Concession Versus Foreign Business Licensing?

There is a lot of terminology that surrounds the corporate legal space if you will. There's a lot of vernacular, a lot of like how do you call it, acronyms and just jargon that you will hear, and I think that this video is worth making. I'm making a series of these because I can provide a little bit of clarification as to differences in certain types of concessions that can be granted here in Thailand with regards to foreigners doing business here through corporate entities.
So I thought of making this video after reading a recent article from the Bangkok Post, bangkokpost.com, the article is titled: Foreign Investment surges in first two months. Quoting directly: "Foreign investment in the first two months of this year saw a 68% increase in the number of projects and a 33% rise in the investment value compared to the same period last year. So that's good to hear. And those that are trying to push this narrative of Thailand is in economic trouble, I think that this kind of goes against that, to say the least. That said, quoting further: "According to Deputy Government spokeswoman Sasikarn Watthanachan, the latest report on foreign business investment approvals under the Foreign Business Act (1999) reveals that 181 applications were approved in the first two months of this year marking a 68% increase compared to the same period last year. Of the total, 41 investment projects came through the Foreign Business License application channel with 140 from the Foreign Business Certification letter application."
Okay, so jumping back in here - “Projects came through the Foreign Business License application channel"- now understand, there's a licensing protocol that exists under the Act to possibly get licensing of foreign businesses in Thailand. It is not as widely used as some other routes for a variety of different reasons, oftentimes may be slower, there may be not the sort of concessions one is looking for at the end of the road, there are a variety of different reasons for picking it as opposed to what we will call and quoting further: "Foreign Business Certification letter." That is a different animal. That comes from the Board of Investment that is then converted if you will into effectively a Foreign Business License pursuant to the powers of the BOI to grant concessions to foreigners doing business in Thailand.
So, they are kind of two different things: one operates under the Act, one is sort of semi-discretionary as a result of the powers vested in the Board of Investment to grant concessions to foreigners here in the Kingdom of Thailand.
