Thai Board of Investment: Land Rights Concessions?

As the title of this video suggests, we are discussing Thai Board of Investment the BOI, and the possibility of certain concessions pertaining to real estate rights here in Thailand. I thought of making this video after reading a recent article from The Chiang Rai Times, that is chiangraitimes.com, the article is titled: Thailand Targets Nominee Property Deals, Foreign Buyers Face Rising Legal Risk in 2026. Board of Investment (BOI) Promotion: BOI promoted companies may receive exemptions from some foreign ownership limits, including full foreign ownership in approved sectors. In some cases, those benefits can extend to land ownership for approved projects, often in manufacturing technology, or tourism."
Yeah, I don't bring it up maybe often enough. BOI does, they can grant a number of concessions associated with doing business in Thailand not least of which is the ability to issue a Foreign Business Certificate which can allow foreign ownership of a Thai Company, kind of similar to the way Americans can do business; if certified under the US-Thai Treaty of Amity Americans can own their businesses 100%. Other nationalities could do that under a possible BOI structure.
It's also important to point out, BOI also can grant concessions regarding land ownership, but again this is where one has to look at the sort of policy thinking behind the ability to issue these kind of concessions; it's for an ongoing concern. So it's like owning the land under which a factory would sit or something akin to that, or maybe if you set up a big spa or data centre in Thailand and you want to own the underlying land, BOI may have the ability to grant a concession to allow that. But again, it's not to just own land so that somebody can like live on it, it's for an ongoing business concern. And again, I have talked about this, even 49/51 type structure companies could in theory own land and for legitimate reasons, but again if it's for an ongoing concern. Again, it's not just, "hey I'm a foreigner; I'm using a company to own a house and live in it." No it's for business activities. And the Board of Investment here in Thailand is able to grant concessions in a similar manner for those wishing to do business and set up business operations here in the Kingdom of Thailand.
