Thai Companies to Own Property for Foreigners in 2026?

As the title of this video suggests, we are discussing, well basically we're discussing corporations being set up in order to own property here in Thailand. As we've discussed in other videos, look, there's a lot of nonsense on the internet unfortunately. I did a video talking about getting "yessed" to death. There's a line in the movie Casino where Nikki Santoro is talking to, what's her name, is it Sharon Stone? Yeah, Sharon Stone's character and he says, "you yes me to death", he says, "you yes me to death!" You get that a lot with a lot of real estate so-called agents and unfortunately a lot of foreign fake lawyers here in Thailand. By the way, any foreign national that is in Thailand claiming to be any kind of legal advisor, consultant, anything, they are all frauds.  I've discussed this at length. It's on the restricted occupations; it is noted on the Department of Employment's website via the Restricted Occupations notices and it's written in English; I have discussed that at length. 

That being said, company set ups in order to own property, yes it was something that was done in the past. As I've discussed in other videos there's a very narrow subset of facts wherein it may be possible to do that, again but it usually involves a married couple and it's sort of an ongoing business thing. That said, purely setting up a company just to own property for a foreigner is illegal, just flat out, full stop as the British say. It's illegal and setting up a company to do that is viewed as sort of furtherance of subterfuge to circumvent Thai Law. And in the event that it's discovered a company has been set up for that purpose, they'll basically dissolve the company and seize the assets, seize the land. So it's not a good idea to do that. 

And frankly, in 2026 I think that for the most part, anybody that thinks about doing this is really, really asking for trouble because more and more, law enforcement here in Thailand is serious about this and they've been going after it. We've discussed it in many other videos, yeah law enforcement has made it a point of going after these folks that set these type of structures up; they're very, very serious about this now. 

Again, there may be a subset of people, especially if you're married to a Thai and you want to set up a corporate structure because you're going to do business, what I call the shophouse model - at the bottom level you've got a business, you live above it - again, there may be some circumstances where that may be warranted and even in the eyes of the law with all of the restrictions, it may be possible. But again it's a limited set of fact patterns that that's going to work under. For the most part the vast majority of people that are coming to Thailand, if you're trying to utilize a corporation to own property in Thailand, that's a bad idea and frankly I think it's going to be even more heavily scrutinized and law enforcement is going to go after that more and more going into and throughout 2026.
