Thai Foreign Business Licenses Compared to Certificates?

As the title of this video suggests, we are discussing the difference between Foreign Business Licenses in Thailand versus Foreign Business Certificates. Wow, talk about a set of semantics that only lawyers could sit around and parse the fly poop from black pepper that is the difference between Certification versus Licensing, but here we go. 

I thought of making this video after reading a recent article from the Bangkok Post, bangkokpost.com, the article is titled: Foreign investment surges in first 2 months. Quoting directly: "Foreign investment in the first two months of this year saw a 68% increase in the number of projects and a 33% rise in the investment value compared to the same period last year. According to Deputy Government Spokeswoman Sasikarn Watthanachan, the latest report on foreign business investment approvals under the Foreign Business Act (1999) reveals that 181 applications were approved in the first two months of this year, marking a 68% increase compared to the same period last year. Of the total, 41 investment projects came through the Foreign Business License application channel," - so that's the license application channel - quoting further: "with 140 from the Foreign Business Certification letter application." 

Okay, what's the difference between a Certificate and a License? Foreign Business Licenses are garnered through going through the process as set forth in the statute of the Foreign Business Act of 1999. Foreign Business Certification occurs after the adjudication regarding concessions from the Board of Investment or it's my understanding now, could also come from the Eastern Economic Corridor Board to grant a foreigner the ability to own their own business in Thailand. Once certified, they then basically tell the government issue this person this certification, allow them to run this pursuant to our concession. 

There is a difference; that's the only point we are trying to make with this video. Foreign Business Licensing occurs through one mechanism, Foreign Business Certification occurs through another mechanism here in the Kingdom of Thailand.
