Update On Thai Amity Treaty Companies And Land Ownership

As the title of this video suggests, we are discussing the US-Thai Treaty of Amity. For those who are unaware, the United States and Thailand have a Treaty betwixt each other which goes back quite a long ways, nearly 200 years now but it is a bilateral Treaty and the provisions of which or the latest iteration which was ratified by the Senate in 1966, the latest iteration of the Treaty grants "National Treatment" to American companies looking to do business in Thailand. What does that mean? It means that American companies looking to do business in Thailand do not need to worry about some of the issues which may arise under Thailand's Foreign Business Act which may effectively make a company have to be a 49/51% shareholder set up wherein a Thai national holds 51% in order to not have problems with the Foreign Business Act or you may need to seek a Foreign Business License to undertake that, and that may or may not even be a viable option. With the US-Thai Treaty of Amity this is effectively overcome because the Treaty itself speaks to that and again American companies here are given "national treatment" i.e. they are treated as if they were Thai companies.
The other thing to take away from this, I am making this video as sort of an update because I've gotten a lot of emails lately from folks asking me about land ownership for Amity Treaty Companies. As I have discussed in other videos, land ownership, land trading there are a number of things, inland transport, certain professions are exempted even under the Treaty. So yeah, land ownership under an American Amity Treaty Company is not going to be viable because of the terms of the Treaty itself. The Treaty itself stipulates that notwithstanding national treatment granted for all types of business activity, it is not granted for Americans specifically under the Treaty to engage in any type of business associated with land or land ownership.
So the thing to take away from this video, hopefully this clears up some misconceptions and I hope people take away from this video, they understand the Amity Treaty can be a major benefit for those looking to do business here in Thailand but do not presume that under the benefits of the Amity Treaty, one can get landownership because that is not part of the terms of the US-Thai Treaty of Amity.
