US-Thai Amity Treaty Certification and Incorporation

Transcript of the above video:

As the title of this video suggests, we are discussing Amity Treaty Certification. For those who are unaware, under the provisions of the US-Thai Treaty of Amity it is possible for American citizens to own their companies outright here in Thailand notwithstanding the provisions of the Foreign Business Act which in many cases will require that a company with some foreign ownership be majority owned by a Thai national. Under the provisions of the US-Thai Treaty of Amity an American Company, depending on circumstances, an American Company can be granted national treatment thereby overcoming this. So again, you can be an American, you can have 100% ownership of an Amity Treaty Company.

Now the reason for this video, the sort of thrust of this video is to kind of understand Amity Certification and Incorporation are two different things. The two different processes of dealing with both incorporation and Amity Certification, on top of this, things like Work Permit and Business Visa issuance it can get very circular. It gets into kind of a "cart before the horse", Catch 22; I need this to get that but I need that to get this and it can be kind of daunting for folks who are looking at this for the first time. My suggestion is to first of all understand that yes it is a complex process but also do your own research, try to figure out if this is something you really want to do and make that decision and then honestly maybe it is a good idea to contact a legal professional, gain some insight and guidance into how best to proceed.
