What Documentation Is Required for Amity Treaty Certification?

As the title of this video suggest, we are discussing the US-Thai Treaty of Amity. For those who are unaware, this is a Treaty between the United States and the Kingdom of Thailand. It is a bilateral agreement under the provisions of which it allows Americans to do business in Thailand with "National Treatment" or specifically American Companies to do business in Thailand with "National Treatment". What does that mean? National Treatment means that that Company is treated as if it were a Thai Company so long as it is certified as an American Company pursuant to the US-Thai Treaty of Amity. A major benefit, because the Foreign Business Act creates a number of restrictions on foreigners doing business in Thailand that Americans quite honestly don't have to deal with by dint of the Treaty.
So the question posed in this video is what documentation is needed in order to obtain an Amity Treaty Certification? The short answer is it heavily depends on the facts in the case. Again a publicly traded company setting up a branch here in Thailand or a subsidiary, it's going to be a massive difference in documentation than an SME that comes in here, sort of a one man band if you will who comes in sets up a Company and just wants to do business in Thailand, that's going to be a radically different set of documentation. Quite frankly we end up having very minimal documentation associated with an American SME especially if it is just like one American who is just going to kind of own a Thai Company basically outright, it is very minimal documentation. Again publicly traded companies looking to business in Thailand, or have a subsidiary in Thailand, that is going to be a very different kettle of fish. We have seen documentation that is pretty thick, it is like about this thick associated with an Amity Treaty Certificate Application. So again, it is going to depend on the nature of the business as well as the underlying facts of the incorporated entity or the individuals that are looking to do business here in the Kingdom of Thailand.
