Is Notarization Necessary For Prenuptial Agreements In Thailand?

As the title of this video suggests, we are discussing prenuptial agreements in Thailand. For those who are unaware, yes Thai Law does allow for prenuptial agreements. However, remember there are certain formalities if you're getting married in Thailand. 

In the context of using a prenuptial agreement to for example go to the United States and marry, which we do assist a number of clients every year in getting a Fiancée Visa to the United States, doing a prenup and then traveling to the USA in order to remain there and live there. Under those circumstances we do a different analysis regarding the formalities associated with prenuptial agreements. The question has arisen, "is a notarization necessary?" Well it may not be necessary per se insofar as a prenuptial agreement may not fully come apart simply because it doesn't have a notarization, but I definitely think it is a really good idea to have a notary notarize the signatures on a Prenuptial Agreement. Again it may not be necessary at law exactly, but it bolsters the prenup insofar as there is no question that the people who are deemed to have signed it, did in fact sign it.

So from that standpoint yeah I would say it is a really good idea to have a notarization associated with a Prenuptial Agreement for a Thai or somebody from Thailand if you are going to the United States, and I am looking at this primarily through the prism of the US, but if you are going to the United States, yes I think it is a good idea if you have a prenup to make sure that it is notarized.
