Royal Thai Gazette Announcement Regarding Bail Bonds in Thailand

Re: Cases regarding Bail Bond in Criminal Cases
Announced: 17 November 2017
1. This regulation is called “Regulation of the Head of the Supreme Court regarding how to rule on cases involving bail bond”
2. With effect from day of announcement
3. Explanation of meaning of wording “appointed court employees”
4. As soon as the case is done, when the instruction is issued, the officials have to follow the instructions immediately
5. The assets of the convicted person have to be put down as bail bond as soon as the notice has been sent to the criminal. The official has to follow the steps until completed and the bail bond has been paid (put down).
If the assets used for bail bond are immovable assets documents must be produced together with photographs.
6. In inspecting the assets used for bail bond, besides verbal interviews regarding the assets of the debtor, the officials must follow up be inspecting.
7. If the assets are sold into the market, and the amount is less than the bail bond, the official is able to confiscate additional assets.
8. If money is used as a bail bond, other officials should not distribute this money .
9. At the end of the period of the case, and there are no assets which are still part of the case, the official must make a report to the court to end the case of the bail bond.
10. When a case is dismissed, the guarantor must pay the fee for the case if assets were seized or confiscated and not sold.
11. If it is necessary to find a method to make things more convenient, the Secretary General should issue an instruction to facilitate matters.
12. The Head of the Supreme Court has the authority to make the final decision.
