Thai Police Target "Proxy Owners" "Fronting" for Foreigners?
Transcript of the above video:
As the title of this video suggests, we are discussing Thai Police are seriously scrutinizing corporate structures here in Thailand looking for foreigners who are using proxy owners - sometimes referred to as nominees - to act as front companies here in Thailand.
I thought of making this video after reading a recent article from the Bangkok Post, bangkokpost.com, the article is titled: Police raids target Chinese criminal ownership of tourist villas. Quoting directly: "The listed buyers were companies registered for organized tour packages, and related businesses. Their Chinese clients paid in cash, foreign currencies and digital money. Investigators have found proxy owners registered for more than 40 companies, fronting for the Chinese owners."
So again, what they are concerned about is like foreign national, transnational criminal gangs, folks coming in here to Thailand and utilizing nominees in order to do business. As we have discussed in other videos, there are restricted occupations here in Thailand; there are restricted business activities pursuant to the Foreign Business Act. Under the Foreign Business Act, oftentimes it's required that a Thai own 51% of an ongoing enterprise with a foreigner only able to own 49%. But some people will put up "fronts" in the form of nominees - which are explicitly illegal here in Thailand - in order to meet at least the nominal requirement that a business be Thai owned.
So the thing to take away from this video and understand is the fact that yeah look Thai Police are serious about enforcing the laws regarding nominees here in Thailand, and if they suspect that a given business organization is being utilized as a front for international organized crime, they are going to investigate and they are going to look deeply into it and they are going to possibly maybe even seize the company, maybe take assets, maybe detain people. Again, it remains to be seen but that said, this is serious and for those who think that they can just kind of circumvent relevant Thai Law by using these sort of colour of law strategies, you had better think again.
