Two Bodies of Law Applied When Scrutinizing Thaksin's Conduct?
Transcript of the above video:
I'm making this video today about Thaksin Shinawatra regarding there have been recent cases, and I've seen a lot going on in sort of the ether of the internet where there seems to be some confusion as to what's going on. Like people say ‘well he has been acquitted of everything, or he has not, he's under this, he's under that.”
Let me just dispel some things in one of the instances quite honestly of the Bangkok Post providing a great deal of very concise clarification, I take you to Bangkok Post, bangkokpost.com, the article: Election Commission's probe into Thaksin carries on. Quoting directly: "The Election Commission (EC) will continue to probe former Prime Minister Thaksin Shinawatra's alleged manipulation of the Pheu Thai Party and interference in the coalition Government, even after the Constitutional Court ruled to reject a petition claiming Thaksin and the ruling party had tried to overthrow the Constitutional Monarchy said the EC." Quoting further: "The Court based its judgment on whether Thaksin and Pheu Thai had violated Section 49 of the Constitution, which covers misconduct and claims of whether they exercised their rights and liberties in a manner deemed as attempting to overthrow the Constitutional Monarchy, Mr. Sawang said." So that was the case that was dismissed; they said they didn't do that, okay?
Now, quoting further: "The EC, on the other hand, is looking into petitions received over the Phue Thai Party's alleged violation of the organic law on parties which prohibits a party from consenting to being manipulated or interfered with by an outsider, which in this case is alleged to be Thaksin, said Mr. Sawang." So again, tip of the hat to Bangkok Post on that for just like those three paragraphs just boom, boom, boom. This is what's going on.
So yeah, it looks like it has been dismissed. The matter pertaining to any notion of overthrow of the Constitutional Monarchy that's been dismissed out of the Constitutional Court. That being said, matters pertaining to Thai election Law, basically propriety associated with interaction with the political parties here in Thailand, that investigation appears to still be ongoing, so that's the differentiation to look at there when you're looking at this.
As per usual, when we start to veer over into some of these more political matters, I'm going to go ahead and turn the comments off on this video. This is purely for clarification for folks who kind of want to understand what's going on here. I have seen especially a lot of tourists, I've kind of overheard in the past weeks saying, "well he got off for that, or no he's on the hook for this." Oh expats, especially younger, I call them younger expats, they've only been here a little while, also have kind of been talking; there's been confusion is what I'm trying to say. Hence the reason for the video. I hope this provided some further clarification.
