90 Year Leases in Thailand?

As the title of this video suggests, we are discussing a topic we have discussed before which is the possibility of 90 year leases in Thailand. A recent article from ASEAN NOW, that is aseannow.com, for those who are unaware ASEAN NOW is the legacy website of thaivisa.com this article is titled: Give Foreigners 30-year Visas for 1 million Dollar Investments and Watch Land Prices Rocket says Phuket Group

They go into all of these proposals that have been brought up to spur the real estate market; attract foreign high net worth individuals. One thing that was just mentioned off hand but I thought it was interesting, quoting directly: "But he was in favour of plans to raise lease terms on property from 30 to 90 years." He being CISSA Chairman Attanop Phanthukamnert, so again, he was in favour of raising lease terms from 30 to90 years. For those who are unaware, presently the max lease term is 30 years in Thailand. There has been some serious discussion about going to 50. There are a lot of folks out there that will talk about 30 + 30 + 30 leases. We have done videos on that; there is a lot of nuance there; is a lot of risk in there so you really need to understand what you are dealing with when you go in.

With respect to going from a 30 to a 90 year lease it will be interesting. I have seen situations, the Court has taken the position that leases of that long a term are the functional equivalent of land ownership so I can see a situation where maybe the Courts push back on that a little bit even if it was changed statutorily it would be interesting to see if they interpret it and said hey this goes against another statute. It remains to be seen.

I personally think we will probably see something more like adjustments to condo ownership or possibly even house and land ownership in a Moo Baan set up, a housing development setup long before we will ever see 90 year leases here in Thailand.
