Bequeathing A Thai Condo In A Will?

Transcript of the above video:

As the title of this video suggests, we are discussing bequeathing a Condo in a Will. Yes it is possible for a Will to basically transfer or upon judgment of the Thai Court, transfer title of a condo from one person to another; so a person is deceased and it goes to their heir.

Now here is the rub. You are talking about the Thai Court System so that means the optimal way of dealing with transferring a Condo in the event of one's death, is via a Thai Will. Again in theory, and we have dealt with cases like this, it may be possible to use a foreign will that might have been probated, again, they don't use probate in the Thai Civil Law vernacular - the word or the translation is succession - but I am going to use the Common Law vernacular because that is what I came up in, so again even after a foreign Will has been probated by a Court outside of Thailand, that's not a foregone conclusion and that doesn't do anything with regard to enforcement of that document here in Thailand.

Now it may be possible to request that the Court go ahead and review and possibly order judgment with regard to a foreign Will but when dealing with real estate here in Thailand, I think it is optimal to have a Thai Will, if only for that one piece of property because it is going to be the most optimal way of transferring that in the event someone passes away. Now this stuff can be pretty complicated so for those who are a bit overwhelmed or are looking into this, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
