Foreigners and Thai Real Estate: Condos, Leases, or Something Else?

As the title of this video suggests, we are discussing, Real Estate in the context of foreign nationals here in the Kingdom of Thailand. We are kind of looking at condos and leases.

Most people know about condos and leases. It is possible for foreign nationals to have leasehold title over property here in Thailand as opposed to freehold title. Foreign nationals are prohibited from owning real estate in Thailand unless for example they are owning it in a condo. It is possible for a foreign national to own a condo in Thailand freehold; they can own it outright; can have the title to it, so-called Chanote title or freehold title.

People ask me what about other options, things like mortgages and usufructs? They certainly are out there and depending on your circumstances they may be useful to you. What I find a little bit distressing out there is people talk about these kind of things as if it is like a one-size-fits-all approach. "Oh, a mortgage will always work for everybody," or "a usufruct will always work for everybody", maybe, maybe not. Again it is going to be driven by the specific facts. Then finally there is the situation where under certain circumstances you may have a corporate setup where the corporation may own property in Thailand but when you get into that it gets to be a bit of a tricky thing because again there is a restriction on foreign ownership of Thai property, of Thai real estate, specifically land is the major thrust of it and if it is deemed that such a corporation is used as kind of a subterfuge you can really get into some real problems with respect to that. 

So the thing to take away from this video and to understand is that you need to be careful and really at the end of the day it is probably a good idea to contact a legal professional because you need to be careful in determining what the best course of action with respect to enjoyment of property benefits for you are going to be here in the Kingdom of Thailand.
