How Long Are Thai Leases?

As the title of this video suggests, we are discussing leases here in the Kingdom of Thailand. For those who are unaware, foreign nationals here in Thailand are not allowed to own land; they are not allowed to own real estate in Thailand. 

Now as we have discussed in other videos, there are some very minor exceptions to that but the exceptions really kind of stand out. There's only like a half a dozen instances where that rule has been sort of set aside and it is under major exemptions: industrial estate authority for example. A question that often comes up on people's minds, well I thought of making this video after reading a recent comment on our channel. Quoting directly: "My understanding and this could be wrong as a foreigner or non-Thai was that you can lease the land for 30 years times 3, so can be renewed for a maximum of 90 years. With the freeholder’s permission, you can build what you want depending on planning consent which is good for at least 30 years until you need to extend your lease." 

So the thing to understand is yes, under the Thai, and let me be clear I am not a Thai Attorney, I am an American Attorney; I am the Managing Director of this firm but all this stuff when I make these videos we sort of run it past the Thai legal team and I don't think I'm out on a limb by saying, yes under the Thai Civil and Commercial Code, it is possible for foreign nationals to lease Thai property. Now leases under the Thai Civil and Commercial Code, the maximum duration of such a lease is 30 years so yeah there may be a renewal clause in the lease but the maximum, the total amount of time one can have a single lease in Thailand is 30 years.

So yes definitely possible to get a 30 year lease in Thailand and definitely something I have seen a lot of foreign nationals find great benefit in. The thing to take away from this video though is again foreign nationals cannot own land in Thailand but they can lease it.
