Thai Condo Transfers: Preparation and Timing?

As the title of this video suggests, we are discussing Thai Condo transfers. Now this is sometimes called, especially in the British tradition, conveyancing, so this is like a closing. It's basically the transfer of title from one person or entity to another person or entity and the underlying asset, if you will is a condominium.

For those who are unaware, the Thai Condominium Act does permit foreign nationals to have Freehold title to condos here in Thailand. So a foreigner can own their condo outright; they can have the title deed; that is their title deed that they have notwithstanding the provisions in Thailand that restrict foreign nationals from owning certain types of Real estate, most notably land, the Thai Condo Act does permit this and permits a sort of ownership interest, sort of ownership interest in common via the condo structure. So again not to get too deep into that, I have made tons of videos on that over the years but that's basically what you are looking at there.

Now the question becomes, sort of processing, timing, these types of things and the documentation that you need to prepare in lead up to doing a Thai Condo transfer. Attorneys here in our office will oftentimes perfect a couple of Thai Condo transfers a month at a minimum. Now there is a great deal of supporting documentation that goes into making that transfer most notably maintaining the formalities associated with the Thai Condominium Act in order to obtain Freehold title. Most importantly is proving up that the funds associated with the purchase were brought in from abroad and there is a lot of formality that has to be undertaken in order to perfect that type of transfer. So the thing to understand is timing may be dictated by documentation here. It may not be a situation where you just call up a lawyer and then the next day they are going down to transfer this thing over. No oftentimes it takes multiple days if not a week or two to go ahead and get all the ducks in a row, get everything properly formalized, have everything in line with respect to the Thai Condominium Act in order to convey Freehold title to a foreign national here in the Kingdom of Thailand.
