Did Thai Law "Originate from England"?
Transcript of the above video:
As the title of this video suggests, we are discussing did Thai Law originate in England? I thought of making this video after reading a recent comment on our channel, quoting directly: "Very honestly review. By the way, about the law in Thailand, it may originate from England but of course it is in Thai language. If you may, please remind me some time how the law goes on this day?" I think what they meant was sort of explain to me how all this works.
Thai Law does not emanate from England in any way, shape, or form. Thailand was never colonized. The United Kingdom utilizes the Common Law system much like their American cousins as well as most of the rest of the jurisdictions that make up the Commonwealth. Thailand utilises a Civil Law System and it is uniquely Thai. It has many twists and turns that are just of a unique Thai nature.
Civil Law systems were sort of first introduced on the European continent. Thailand did not again have that imposed. Thailand was never colonized. Thailand has always had its own law. In fact, we did videos on what's called the Three Seals Law some time ago and there is a Supreme Court decision here in Thailand which stipulates that the Three Seals Law remains good law here in Thailand, and it's older. It predates the Civil and Commercial Code. The Civil and Commercial Code was brought into Thailand in the aftermath of the so-called Unequal Treaties, so understand, the Thai Legal System is not based on the English system. It's very different from the Common Law. They have pulled, "pulled" if you will, certain aspects of different legal systems into theirs; they've even pulled various statutes from other jurisdictions and sort of reworked them for their own usage here in Thailand. But understand, this was done of their own accord. And on top of that, oftentimes they modified these things in many ways to more accurately reflect the policy thinking here in Thailand.
So yeah, it would be very much a misnomer to stay that Thai Law originated in England and it's very important to understand that there are very big differences between the Common Law and the Civil Law and between Thai Civil Law and the Common Law and even the Civil Law itself. Thai Law is, if it's nothing else, very much unique.
