Foreigners Arrested for Unlicensed Cannabis Operation in Thailand?

As the title of this video suggests, we are discussing well recent developments here in Thailand with regard to criminal law. I thought of making this video after reading a recent article in the Bangkok Post, bangkokpost.com, the article is titled: Britons busted with Ganja and Laughing Gas in Phuket. Again, I note that this is Criminal Law, but it pertains to Cannabis and I think in this article we are going to get a teaching point to get into for foreigners here with Cannabis because I think foreigners are a little bit misinformed as to where they stand with regard to Cannabis here in Thailand. Let me dig into it here. 

Again, I thought of making this video, the article is from the bangkokpost.com, quoting directly: "Six British Nationals have been arrested with six kilograms of Cannabis buds and 39 small tanks of nitrous oxide, or laughing gas, during a police raid in Muang District of this island province. The raid launched on Thursday, found the six foreign men, all British Nationals, were inside the house, the arresting team said on Friday." Quoting further: "Seized during the raid on Thursday were six bags containing 3 kgs of dried Cannabis buds beside the door of one of the bedrooms and another 3 kgs of buds in six bags inside the room. The occupant of the room admitted the buds belong to him, said police. He failed to produce a permit to sell cannabis buds when asked. The arresting team also seized 39 small tanks of laughing gas from the car park of the house. All six men are being held in police custody." 

Okay, a couple of things to bear in mind, is first of all look I have talked about this at length on this channel many times and I know folks in the Cannabis space hate me bringing this up, but it is a fact. Cannabis is an agricultural occupation; it has to do with agriculture here in Thailand. Notwithstanding the fact we haven't seen a Parliament generated Bill promulgated with regard to regulation of Cannabis, we do have other bodies of law here pertaining to the restriction of occupations associated with agriculture. So that's the first thing you have got to keep in mind is, one) look, Farang, foreign activities in the Cannabis space here in Thailand are highly truncated. Now in this situation, on top of everything else, this person was caught with a large amount of Cannabis and they have no license to sell. Now folks who may say, 'well where does that leave me?' Well do you have 3 kgs of dried cannabis and another 3 kgs of buds in six bags hanging around your house? No. That's a large amount. It's sort of like in a criminal context we look at back in the United States, for example possession and then you have possession with intent to sell as the amount of whatever product or whatever substance you have increases, then you get up into the trafficking category in a criminal context in other jurisdictions and they say ‘Hey you have got so much that we now consider you a trafficker’. Again, we're not in that but it's analogous and you need to understand again, without proper licensing associated with Cannabis here in Thailand, foreigners can find themselves in a situation, a really bad situation where they may find themselves arrested, detained, possibly deported, and possibly blacklisted from the Kingdom of Thailand.
