Notarization, Document Certification, and Estate Planning in Thailand?
Transcript of the above video:
As the title of this video suggests, we're discussing notarization, certifications, and Estate Planning in Thailand. I have had a lot of inquiries lately for folks looking for notary services and depending on the circumstances, we may or may not be able to provide assistance that can actually add value.
What I'm talking about here is sometimes when you are dealing with stuff, especially in the United States, they want a notary that is in the United States or an American notary. We are not able to provide that service directly here in the office. We do have folks we can refer people to to assist with notaries; it is possible under some circumstances to deal with notarization digitally. But in many circumstances, specially where it involves estate planning or estates where you have basically got a deceased back in the United States, you have to sign something that needs to be notarized in order to for example transfer title on real estate or something of this nature. They may actually want to see a physical notarization from an actual notary. Unfortunately, under those circumstances, your only recourse may be to go to the US Embassy as they can provide notarial services. That said under some circumstances a Thai notary may work.
Now meanwhile, Thailand is in the process of acceding to the Hague Convention on certification of documentation, Apostille if you will. Again that's kind of currently in a state of transition where we are not quite over into that yet - into that regime - although presumably that should be happening sort of sooner rather than later.
That being said, just the details associated with for one thing drafting a Will in Thailand often requires a Thai notary, but dealing with notarizations and certifications in the aftermath of someone, especially somebody for example in the United States, Europe, UK, elsewhere around the world, passing away and then needing to deal with document certification from here in Thailand, all of that is going to be driven very much by the underlying circumstances in a given case.
