Clarification Regarding Foreign Condo Quotas in Thailand

As the title of this video suggests, we are discussing Thai Condo quotas. As we have discussed in prior videos, generally speaking, condominiums have this - well not generally speaking, it's the law in Thailand - first of all foreigners are not allowed to own land and they are highly restricted from owning real estate in Thailand. 

Now that being said, it is possible for a foreigner to own a condo in Thailand. Pursuant to the Thai Condominium Act it is possible for foreign national to own a condo in Thailand with "Freehold Title", what we would call Fee Simple Absolute title in the Common Law vernacular, what is sometimes referred to as Freehold Title I hear from the sort of Westminster sort of side of the Common Law vernacular, I hear it called Freehold; we call it Fee Simple Absolute in the American vernacular. In any event it's a title deed, you have the Chanote Title, what is called a Chanote in Thailand, you have the title to your condo. That being said, there are presently quotas on the numbers of condos that foreigners can own. So it's 49/51. A condominium complex can only be owned 49% foreign freehold, the other 51% has to be held Thai Freehold. 

That said, we have had a lot of comments on our channel recently where people have said, "so does that mean I can't own multiple condos?" No. One person could conceivably own, who's a foreigner I should say, could conceivably own the entire 49% so long as they don't beat the 49% - they don't overcome that threshold and thereby engage in illegality - but yeah it is possible for foreigners who are in Thailand and want to own multiple condos, you can own multiple condos. You can own multiple condos in the same complex just so long as it all comes under the foreign freehold quota.
