"Illegal Short-term Renting of Condominium Units" in Thailand?

So, condominium units and the illegal renting thereof is something that seems to be increasingly of concern to authorities here in Thailand.  

I thought of making this video after reading a recent article from the Pattaya Mail, that is pattaya.mail.com, the article is titled: Thai Lawyer downplays expat Visa awards versus personal taxation worries. Quoting directly: "As regards Thai Immigration Authorities, their main concern is Visa-related regulation and investigations into business frauds such as unauthorized working, use of nominees and shareholders and illegal short-term renting of condominium units." 

People will say, "well what are you talking about, illegal short-term renting?" Airbnb is not explicitly legal here in Thailand and under many fact patterns, usage of Airbnb can lead to even criminal penalties here; it can be a real problem. Meanwhile, if you are a foreigner that owns a condo, the act of renting can be considered a service unto itself and require work authorization. I've gone into the analysis on that in the past. People don't love it when I talk about it, but I have dealt with colleagues over the years that have actually dealt with cases where yeah actually renting a condo led to a Work Permit violation and in one case of deportation. So this is not one of those things to just completely dismiss out of hand. Yeah, I get it, if you rent somebody your condo for a month and, you know, "if a tree falls in the forest and nobody hears, it doesn't make a sound". I get the logic. 

But that said, understand the underlying law is what it is. Illegally renting condominiums in Thailand can lead to real problems for foreigners because one, it could be a Work Permit violation and two, just usage of apps like Airbnb could be a violation in and of themselves.
