Can I Leave My Condo to Someone in a Thai Will?

As the title of this video suggests, we are discussing Thai Wills and a question came up. Somebody asked me, they said: "Can I leave a condo to someone in my Thai Will?" It essentially came up in the context, for those who are unaware foreign nationals can own freehold title to condominiums here in Thailand notwithstanding the restrictions on land ownership to foreigners here in the Kingdom generally.

With that comes certain formalities that have to be met when dealing with the Thai Condominium Act. So getting that freehold title registered requires a great deal of formality associated with banking and dealing with the land office but once it is freehold owned by foreign national, the question becomes "Can that transfer to somebody via my Will?" The answer to that is "yes". Furthermore the answer to: "Can it transfer to a foreign national?" is “Yes”. It is possible to transfer a condo from one foreign national to the other under a Thai Will. We have set up many Thai Wills which stipulate that a condominium shall be bequeathed to a given individual upon their death; they will bequeath it on their death to another individual. 

The thing to take away from this video, that is certainly possible. It can be a little complex. There are a number of formalities associated with doing that and for those who are looking to go ahead and formalize a Will in such a way, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
