Changes to Thai Will Drafting Procedures in 2025?
Transcript of the above video:
I have to admit that the title of this video is not exactly misleading, but it poses the question are there going to be changes to the Will drafting process in 2025? Substantively and in any meaningful sense I don't think it's really going to change. That being said, I basically am making this video closing out the year if for no other reason than to remind those who don't have a Will in Thailand and think they might need one, it's better to do it sooner rather than later.
Now again, talking about Wills can be a little bit macabre. Nobody really likes to think about their own passing but especially for those who have loved ones here in Thailand, or elsewhere, for example you may be a foreigner that owns a condo here in Thailand and you have loved ones in another jurisdiction, that's a major asset, you want to go ahead and have a Will that stipulates exactly who gets that either foreign or Thai - both are a possibility - especially if you have a foreign freehold quota condo. As we have discussed in other videos, it is possible for foreigners to own a condo outright here in Thailand and I don't foresee that changing any time soon and it's probably very, very likely that there are many foreigners that will continue to buy condos and thereby really need an instrument to convey that, especially to a foreign relative in the event of someone's death.
So while the procedures and protocols associated with drafting and formalizing a Will here in Thailand do not look set to particularly change, I do expect, especially with the amount of condo sales we have been seeing, those folks who are buying those kinds of assets probably will also be looking and needing a Will so I expect we will probably see an uptick in the need for Wills going into 2025 here in the Kingdom of Thailand.
