Does My Thai Spouse Need a Will?

As the title of this video suggests, we are discussing Spousal Wills, what I oftentimes call these Reciprocal Wills. Oftentimes you will have spouses, and they will both basically get Wills that cross over, basically in favour of each other. That's the way that the Will will work. 

This is a pretty common practice but sometimes people ask, "does my Thai spouse really need a Will?" This is often asked because the foreigner is viewing, they are viewing things purely from their own prism, or through their own perspective, and they are basically saying "oh I want to get a Will for myself because I have assets and things, and I am worried about my spouse." But they don't think about the other side of that equation. This can be especially acute of an issue, especially where there is property involved, where there are living arrangements involved. Again each individual case, the underlying facts in the case is going to drive the analysis regarding whether a Will is necessary and if so under what circumstances and how it should be drafted, and under what circumstances it would be what we would call in a Common Law vernacular “probated” or put through the Courts here in order to determine who the Executors and Beneficiaries are. 

But long story short, generally speaking, and again not every case, but generally speaking, it is oftentimes optimal to at least have reciprocal Wills and in certain cases, people really underestimate in my opinion the need for the Thai spouse to maybe need a Will because there are a lot of unforeseen things that can come up in the event that one's Thai spouse passes away here in the Kingdom of Thailand.
