Lease Perfection In Thailand?

As the title of this video suggests, we are talking about lease perfection in Thailand. When we use the word 'perfection' we are talking about going through all of the necessary formalities in order for a lease to be considered legally enforceable. 

So again, the facts of a given case are going to drive the analysis on what the formalities of the lease perfection should be, but generally speaking, a really good rule of thumb to have here in Thailand are ‘leases over 3 years should definitely be registered in order for them to be considered perfected, fully perfected, from an enforcement standpoint’. 

Now again, I understand there are factual scenarios where you have options associated with leases and things of that nature and perhaps registration of a lease on the Title Deed or Chanote, which is the word for a Title Deed - what we would call Fee Simple Absolute Title in the American Common Law tradition or Freehold Title sometimes is what it is called, for example the Australians and the British seem to use that term - but yeah for Title Deed or for a Lease you need to have a long-term lease, longer than 3 years for enforceability purposes for perfection, you want to go ahead and have that thing registered on the Title Deed with the Land Office here in the Kingdom of Thailand.
