Is A Notary Necessary For A Contract In Thailand?

As the title of this video suggests, we are posing the question, "are notaries necessary as it pertains to contracts here in Thailand?" Not necessarily. It is not an absolute necessity. I had a chat with the lawyers, the Thai lawyers here in the firm. Just to be clear, I am an American Attorney; I'm a naturalized Thai citizen but I am not a Thai lawyer, I am not a Thai Attorney. I sort of look at this from an outsider's perspective but is a notarization necessary for a contract. No, it's not necessary per se.
Generally speaking, the consensus around the office seems to be if you can have a notary go ahead and notarize a contract. It's a good idea because there is no question that the people that ostensibly signed it, did in fact sign it. That said is it a formality that is an absolute must in order for a contract to be deemed enforceable here in Thailand? Not necessarily, but again as a rule of thumb if you will, it is a pretty good idea to have any type of legally binding document notarized if you can and the same would go for a contract.
I think it is safe to say that it would be a good idea to have a notarization done for any contract signed here in the Kingdom of Thailand.
