As the title of this video suggest, we are discussing Thai Wills and Bank Accounts. This is usually when we are talking about what we refer to in the Common Law system as probate or in the Thai system they call it succession, or what is translated to the word succession but similar, the dealing with decedent's estates.

Bank accounts are arguably, how do I put it, we deal with Bank Account issues more than almost any thing in decedent's estates here in Thailand. So what are we talking about? Oftentimes in order to gain access to a deceased loved one's or essentially benefactor’s bank account if there is a Will out there, you are going to need to go ahead and probate that Will or process it through the succession system of the Thai Court specifically. So, that is going to require a little time, it is going to require some effort; you are going to need to go ahead and the Court has to make a determination the Will is in fact genuine; the person who made it had testamentary intent, had the mental competence to make the Will before they are going to go ahead and make a final determination as to whether or not the terms of the Will should in fact be given force and effect of law which is effectively what occurs at the conclusion of one of these things. Upon that happening, then it is possible to essentially order the bank to go ahead and turn over the Bank Account to whomever it is appropriate to turn over to per the terms of the Will. That may be a beneficiary, that may be an heir, that may be an Executor, it just depends on circumstances. 

So in my opinion one of the major reasons for having a Will in Thailand more than anything, although condos are a major thing, property ownership this type of stuff, one of the major issues is Banking.
