Verification of Identity Documentation in the Context of Thai Wills?

As the title of this video suggests, we are discussing the issue of Thai Wills and specifically discussing identity documentation verification associated with Thai Wills.

Oftentimes when folks contact us about drafting a Thai Will, we send them our intake documentation, our organizer and oftentimes my Thai colleagues, the Attorneys who actually draft the Wills in line with Thai Law so as to be utilized in the Thai Court system; we would call that Probate in a Common Law vernacular; it's called Succession in the Thai vernacular. That said, I oftentimes get a little bit of a kind of a push back from clients when we send our requests regarding ID documentation especially, specifically identity documentation pertaining to not only the person who is drafting the Will, but their beneficiaries and possible executors as well and a lot of folks are like "why do you need all this?" 

Well look, at the end of the day, especially if you're a foreign national who is undertaking or who is drafting a Will and then utilizing a Will in the aftermath of one's passing here in Thailand, the Court is going to heavily scrutinize documentation because they are dealing with a foreigner. When they are dealing with a Thai national, basically they can just plug in their Thai national ID, see everything they need to know about them in order to process that case through. When they are dealing with foreign nationals, they don't exactly know who they are dealing with, so they really need a robust background if you will with regard to those people's identity. You can't just put down, "hey I want Jane Smith to inherit my house, or my condo here in Thailand." That's a problem. Why is that a problem? Well because they don't know who Jane Smith is. They need the documentation associated with that beneficiary in order to verify who they are when it processes through the Court. 

So these are the reasons why we ask for rather exhaustive documentation when we are looking to go ahead and draft a Will for a foreign national here in the Kingdom of Thailand.
