Criminal Charges And Deportation From Thailand?
Transcript of the above video:
As the title of this video suggests, we are discussing criminal charges and deportation from Thailand. I thought of making this video after reading a recent article from the Bangkok Post, that is bangkokpost.com, the article is titled: 'Kicking' Swiss man in Phuket loses Visa. Quote: "The possibility of deportation would depend on the resolution of his criminal cases, the Commissioner said."
So as we have discussed in many prior videos, this case has made quite the splash here in Thailand; a lot going on there, I am not going to really get into the high weeds of that. Go back and check out that article, a lot of good information in there, we are quoting a small excerpt from that.
Long story short, and the thing to take away from this video is, yes criminal charges could dictate whether or not somebody would be deported from Thailand. In this case, as we discussed, the Interior Minister himself has come out and said "look, no new Visa is going to be issued for this person". So as we discussed in the other video, there is a difference between just not getting a new visa and actually being actively deported, so there are two different things going on there. That said, the thing to understand is part and parcel of having a criminal charge here in Thailand is the fact that it could also heavily disrupt your Immigration status here in the Kingdom and this could be for a relatively small charge too. There's no sort of threshold associated with "oh well these types of charges are not going to be deportable and these types are. Thai Immigration has a great deal of discretion especially when it comes to issues pertaining to Public Health and Safety as well as National Security, to make determinations as to whether or not somebody who has been criminally charged should in fact be deported and not allowed to return to the Kingdom of Thailand.
So the thing to take away from this video is when or if you do happen to find yourself at odds with the legal system here in a criminal context, it is not a bad idea to contact a legal professional, gain some insight and guidance into how that interacts with Immigration matters in the Kingdom.
