Entertainment Licenses, Thai Companies, and the US-Thai Amity Treaty?
Transcript of the above video:
As the title of this video suggests, we are discussing Amity Treaty and Thai Companies and Entertainment Licenses. I have talked about entertainment licensing a couple of times in the last few weeks. The issue has come up, an MP out of Phuket has been talking about alcohol licensing, entertainment licensing, we have got all these issues associated with cannabis licensing; it's a complex issue.
That being said, I thought of making this video after reading a recent article from the Bangkok Post, bangkokpost.com, Police step up nominee holding cases on Koh Samui, Koh Phangan. Quoting directly: "The Royal Thai Police are intensifying investigations into alleged nominee land holdings by foreigners on Koh Samui and Koh Phangan in Surat Thani, a practice that may threaten economic security, especially in key tourist areas." Quoting further: "Pol. Lt. Gen. Yingyos Thepjamnong, assistant commissioner, said authorities are working closely with Surat Thani Provincial Officials, the Land Department, and Department of Business Development and security agencies to scrutinize cases."
The point of that is there is heavier law enforcement scrutiny on corporate structures here in Thailand. The entertainment business can invite extra scrutiny associated with that inherent business activity. This is the reason oftentimes it is a good idea to have competent legal professionals who are used to dealing with all of the regime of the administrative - basically the administrative state - dealing with all the corporate paperwork as well as licensing documentation associated with such endeavours in order to basically have all of one’s ducks in a row. For Americans, this is especially noteworthy because Americans can own their companies outright here in Thailand under an Amity Treaty Company Certification.
Now different activities in the entertainment business may or may not be restricted to Amity Treaty Businesses. Those who feel a little bit overwhelmed by all of this stuff, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
