Investigating Companies Using "Thai Nominees To Skirt Labour Regulations"?

As the title of this video suggests, we are discussing well quite honestly we are discussing the upshot of what has been going on with the so-called 'beach bully' case. As I discussed in prior videos, I told people "hey take heed of this because I think there is going to be a lot of ramifications coming off of this case", and lo and behold, I did prove to be somewhat accurate with regard to that. 

I thought of making this video after reading a recent article from the Bangkok Post, bangkokpost.com, the article is titled: Companies under scrutiny over use of Thai nominees. For those who are unaware, nominee shareholders in the Kingdom of Thailand are illegal and when it is deemed that such folks are being used if you will, in an effort to either circumvent certain rules in Thailand regarding land ownership or certain rules in Thailand regarding labour restrictions. Again foreign nationals are not permitted to work in Thailand in the same manner as are Thai Nationals, there are certain restrictions in Thailand specifically the Foreign Business Act gets into some of those restrictions. Then on top of that, there are specifically restricted occupations here in the Kingdom of Thailand that restricts certain types of work to Thai nationals only. 

Again, I thought of making this video after reading this article in the Bangkok Post, bangkokpost.com, the article is titled: Companies under scrutiny over use of Thai nominees. Quoting directly: "Nine companies in Phuket will be investigated for the suspected use of Thai nominees to skirt labour regulations which restrict certain businesses to Thai citizens, according to the Department of Special Investigation." As we discussed, there was this sort of 'beach bully' case. That put a great deal of spotlight on this one individual who was alleged to have assaulted somebody and there is property encroachment issues that have popped up in that; I made other videos on this channel regarding that. We have also gone into issues with respect to visa revocation and appeal of certain negative decisions in an immigration context here in Thailand. Again, I urge those who are watching this video, if you want to get into that you can probably go to the search function in our channel or go over to the resources section of our firm over at legal.co.th and just type in the search function ‘Beach Bully’ and you will pick up those videos and be able to find out some of the backstory on all that. 

The point of this video is to understand that the ramifications of all of this scrutiny are that now we are seeing other foreign businesses being investigated as well as a result of the scrutiny being placed in that case. And as discussed in another video, this can have wide-ranging ramifications especially for the foreign business community here in Thailand. Now how exactly this plays out remains to be seen so we will certainly keep you updated on this channel as the situation evolves.
