Should the TM30 Law in Thailand Be Changed?
Transcript of the above video:
As the title of this video suggests, we are discussing the TM30 here in Thailand. For those who are unaware, TM30 pertains to reporting of addresses for foreign nationals remaining in the Kingdom on a long-term basis.
Now something to keep in mind, please note this does not pertain to Lawful Permanent Residents in Thailand; folks in Thailand who have Residence who have a red book, they are considered Permanent Residents in Thailand. That is a very different thing from somebody who is maintaining a Non-Immigrant Visa in Thailand; again they made be residing here in sort of the colloquial sense, but they are not Lawful Permanent Residents, they do not have Permanent Residency, legal residency in Thailand, they're simply here at least ostensibly in Non-Immigrant status, presumably on a temporary basis.
I thought of making this video after reading a recent article from the Pattaya Mail, that is pattayamail.com, the article is titled: Expanded Homestay seen as a booster for Thai tourist numbers. Quoting directly, and to put this into some context, we have discussed this in other videos, Thailand, the new Party that is presumptively going to be the Party that forms the next Government although that remains to be seen, they have sort of proposed as sort of a policy measure the notion of sort of decentralizing certain aspects of the tourism economy and to that end have proposed a notion of sort of a Homestay program wherein foreign nationals can come to Thailand's and sort of stay and possibly in exchange for some light work or something, sort of stay at someone's home and even possibly get a visa specifically for that purpose. That being said, the thrust of this video is sort of different from that article so it may be warranted for those who are watching this video, maybe go check out that article and read that for further detail, gain some further insight. That said, again the article is titled: Expanded homestay seen as a booster for Thai tourist numbers, Pattaya Mail, pattayamail.com. Quoting directly: "Those offering home stays at present are responsible for registering the address of foreign guests on arrival. If they don't, then the luckless tourist is sometimes fined by Immigration at a later stage when they apply for an extension of stay."
So the thing to keep in mind is TM30 is this notification; it is notifying the Immigration Office of one's address in Thailand and one needs to keep it up; it has to be reviewed; it has to be renewed on a 90-day basis. It is definitely the cause of a great deal of consternation associated with foreigners looking to remain in Thailand on a long-term basis and bear in mind there doesn't appear to be anything on the books at the moment that would amend Thai Law at present to terminate TM 30. So keep in mind, TM30s are still required to remain in Thailand. Those in Non-Immigrant status still need to file them in order to maintain status but in the future, it may be possible that this may be terminated. We will certainly keep you updated on this channel as that situation evolves.
