Thai Authorities Scrutinizing Foreigners Engaging In Restricted Occupations?

As the title of this video suggests, we are discussing foreigners and restricted occupations here in Thailand. What are we talking about? Well it is not an unfettered right for a foreign national to work here in Thailand and even on top of that, even if you do get Work Permits, there are still restricted occupations wherein there are certain work, job descriptions, whatever you want to call if, there are certain work activities which are restricted to Thai nationals only. 

I thought of making this video after reading a recent article from the Bangkok Post, bangkokpost.com, the article is titled: Companies under scrutiny over use of Thai nominees. Now as we discussed in prior videos and I urge you to check out this article in detail, get the information in there, but basically it looks to me like one of the upshots of this recent case involving the so-called alleged 'beach bully', part of the upshot of that and I said this sort of at the time that the story was breaking, this could have major ramifications, broad ramifications for all foreigners in Thailand and I think we are seeing that play out here with regard to the issue of foreigners engaging in restricted work. Again, Bangkok Post, bangkokpost.com, the article is titled: Companies under scrutiny over use of Thai nominees. Quoting directly: "Nine companies in Phuket will be investigated for the suspected use of Thai nominees to skirt Labour Regulations which restrict certain businesses to Thai citizens according to the Department of Special Investigation." Now as we discussed in other videos, nominees themselves are illegal in Thailand. You are not allowed to use nominees effectively to front for companies in a corporate context. Quoting further: "Companies will also be examined by other State Agencies to determine whether they have all the licenses required to operate their businesses, such as tour guide services." Yeah this is where we are getting into the restricted occupations issue. Because for example, in Thailand authorities are very sensitive to foreign nationals for example engaging in tourism related activities as again these are certain restricted occupations. These are occupations restricted to Thai Nationals and there is a whole list of them. It’s not just tourism and tourism related businesses that may get you into hot water with regard to restricted occupations. So the thing to understand is when you are getting a Work Pit is probably a good idea to be dealing with somebody that has a great deal of experience dealing with Work Permits, dealing with how Work Permits are issued, dealing with how job descriptions are set forth in Work Permits and dealing with the various laws here in Thailand regarding restricted occupations to foreigners. 

So again, those that feel a little bit overwhelmed and are looking to come to Thailand to engage in business or take up work here in the Kingdom, probably not a bad idea to contact a legal professional, gain some insight and guidance into how best to proceed.
