Thai O Retirement Visas: 90 Day Reporting and Re-Entry Permits?
Transcript of the above video:
As the title of this video suggests, we are discussing Retirement Visas, 90-day Reporting and Re-Entry Permits. I thought of making this video after reading a recent comment on our channel, quoting directly: "Just a quick and maybe silly question. If you have an O Retirement Visa valid for a year and have to leave the country for an extended period, let's say 6 months, and having got your Re-Entry Permit, is either or both invalidated by not carrying out your 90-day reporting?"
Let's be clear, 90-day reporting pertains to physical presence in Thailand. If you are in Thailand for 89 days plus going to the 90th day, you are then required to report your address to Thai Immigration Authorities; this is pursuant to the Immigration Act of 1979. As we have discussed in many other videos, certain Immigration Offices are trying to streamline this process; Thai Immigration is now creating online platforms to go ahead and do this so I think longer term 90-day reporting, notwithstanding the fact that it may be kind of a pain in the rear, I mean in my opinion 6-month reporting probably would be enough, 90 days just seems a little, like a little bit too much. That said, the paradigm at the time the law was drafted was a lot different. Non-Immigrant Visas were viewed a lot differently, they are not viewed with the same permanence. That said I mean I think the law could probably be revised and updated but the thing to remember is if you are abroad, 90-day reporting doesn't pertain to you because you are outside of the Kingdom and therefore you are not subject to the 90 day reporting. Now bear in mind, the validity of your Re-Entry Permit because if that runs out then you have to return to Thailand not in the Visa status you had previously because the Visa expires with the Re-Entry Permit, they're sort of connected together.
But long story short, yeah 90-day reporting not required if you are not physically present continuously in the Kingdom for a 90-day period.
