Thai O Visas and Condo Ownership?
Transcript of the above video:
As the title of this video suggests, we are discussing the Thai O Visa specifically and we are discussing it in the context of condo ownership. For those who are unaware, Thai Law prohibits specifically land ownership, it restricts land ownership from foreign nationals. That being said a major benefit to many foreigners here in Thailand is freehold condo ownership pursuant to the Thai Condominium Act. What are we talking about there? We are talking about the actual Act that allows foreigners to have freehold title, that is Fee Simple Absolute in kind of an American common law context, Freehold title, full Chanote title, full ownership to a condo definitely allowed in Thailand and again, so long as it comports with the Act.
I thought of making this video after reading a recent comment on our channel quoting directly: "Give retired/condo owners a better Visa requirement." and this was in reference to a prior video about how to stay in Thailand. I sort of get the reference here, I think I get the reference. There was a time when there were a lot of O visas issued simply to those who had a condo in Thailand. Now that was never official policy that just because you had a condo you could have an O Visa but there was going back kind of a paradigm in the past among Thai Immigration Officers that hey, if somebody has a condo that demonstrates that maybe we should go ahead and give them an O Visa, just a standard O Visa. They might not have hit the retirement age, 50 here in Thailand, they might not have hit that age but they had a condo and in the past, many Immigration Offices would issue an O Visa based on the fact that one had a condo. That is no longer quite the practice it once was.
Now that being said, all cases are different and different Immigration Officers may exercise their discretion differently but as a broad base, in a broad sense, as a practical matter, it is not very often, in fact I haven't seen it in years where you see an O Visa issued purely based on the fact that a foreigner has a condo or owns a condo here in the Kingdom of Thailand.
