Thai Work Authorization Rule Changes in 2025?

Transcript of the above video:

As the title of this video suggests, we are posing the question, 'could work authorization changes occur in 2025?' So rules regarding foreigners working in Thailand. As we have discussed in other videos, foreigners do not have an unfettered right to come to Thailand and work in any capacity and as I have discussed in other videos, the definition of work in Thailand is pretty stringent insofar as like breathing could in theory be defined as work; any exertation of energy can be defined as work.

Now during 2024 we saw some major developments in Immigration most notably the creation of the Destination Thailand Visa and the rollback on rules regarding "remote" work here in Thailand. As we have discussed in the past, even getting on the phone or emailing could have been considered work under some of these changes that are happening both within the DTV regime as well as outside of it there's continuing talk of liberalizing employment authorization rules. A lot of that is talk though, okay? And the thing to bear in mind is we saw a definitive response on that from the Ministry of Interior where they said that I quote: "Nothing can "impinge" upon the Thai economy with regard to this "remote" work kind of stuff." So, the notion that somebody can quit their job and then restructure themselves and claim that they are working remotely because they are making phone calls and emails, they are not really working in a facility or something here in Thailand, that's not going to work, okay?

What's happening moving forward is yeah, for true nomadic kind of people that are working remotely if you get on a phone call or a computer and send an email or make a call regarding something that's happening that doesn't pertain to Thailand, no, nobody's looking to kick down your door over that. But that said, and what's wise to remember going into this year is there have not really been any substantive changes to the employment authorization rules; it's simply a matter of again remote work, the sort of more modern notion of working from far away from where your actual place of work is, that has changed and Thai law has to some extent evolve with that. But again, let's not rule out the possibility that stringer rules will remain especially as to work authorization that would, and I quote: "impinge upon the Thai economy".
