Is Thailand a "Failed State" for Allowing Fake Foreign "Professionals"?
Transcript of the above video:
As the title of this video suggests, we are asking the question, is Thailand a failed state for allowing these fake foreign professionals? What are we talking about here? I thought of making this video after reading a recent article from the Bangkok Post, bangkokpost.com, the article is titled: Foreign Crackdown pushed. Quoting directly: "Fears about Thailand becoming a failed state have grown recently because of its failure to enforce laws, allowing cross-border crimes to erode public confidence in the country's safety and security. These incidents have already affected Thailand's tourism sector as the Chinese market ebbed in the first two months this year, as did Taiwan and Hong Kong, whose residents fell victim to scammers."
Well first of all, let's put that into some context here. I think a lot of pearl clutching is going on and over-exaggerating some of that, but let's go further here. Quoting further: "Business operators have expressed concerns of a weak law enforcement in Thailand, including entanglement with corruption, believing it will eventually impact the economy if the government fails to protect the country from crime and similar threats posed by those who exploit legal loopholes for personal gain, such as foreign business using nominees.” And more to the point too, all of these fake professionals, you want to talk about undermining the notions of the rule of a law in Thailand, how about we get rid of the fake foreign lawyers. And for those who think that's not a thing, go look up all Brian Wright. That guy faked being a lawyer here in Thailand for years. I mean literally years. That guy just was a total fraud, faked being a lawyer and nobody did much of anything about it. Quite frankly, I was angry with the embassy over those days as I am with anybody, and I'll get into it here in a moment. I want to know where law enforcement from the US side is going to come from with respect for to some of these frauds here in Thailand that are of American extraction Brian Wright being one of them. By the way, that guy was ultimately convicted of charges involving child sexual abuse and the guy got I believe, convicted for like 10 years was the sentence, where is he? Is he in jail somewhere? I think Andrew Drummond years ago was following that; I'd be very curious to know where that guy's at. Hey, here's another scammer for you. How about a total fraud Dennis Ramm heading up old Siam Legal so-called - I mean it's hard to use the term "Legal" when you have a guy who has got no business calling himself a lawyer, and before those out there say, "oh he doesn't do that", I have the evidence he does; it's in a safe; he used to do it all the time; it's a continuing criminal conspiracy in violation of 8 CFR 292.1 to say the least as it pertains to US Immigration. So, there's another one for you, and I have let AmCham know that before too. I have said, "why do you guys help somebody who actively subverts American law?" To say nothing on top of that of the so-called Stamp-Pimps coming over here who are literal agents of the IRS, and they are giving out and consulting on Thai Tax matters here in Thailand, that I can't figure out where the legality is for that. And then to say nothing of all of these people coming into Thailand in either Visa Exemption status or so-called DTV status or ED status, who are in violation of, as I recall, if you'll excuse me here for a second, I can quote again from the same Bangkok Post article. Quoting from Paisarn Suethanuwong, quoting directly: "Allowing illegal foreign guides to persist in major destinations" - he's talking about tourism specifically, - "opened the door to other nominee businesses including tourism companies, transport and real estate, causing local operators to lose income." Quoting further: "Though we already have comprehensive laws in place such as Section 12 of the Immigration Act" - which pertains to those coming in on DTV or Exemption - quoting further: "which prohibits foreigners from entering the country for employment purposes. The problem is our enforcement is not strict enough." Yeah, I'd say that's about right.
At the end of the day, Section 12 of the Immigration Act precludes those coming in on Exemption or any other type of Non-Immigrant status without some sort of work authorization, which again as I have done the videos in the past, even BOI has tried to say, "oh it's inherent to the Visa itself". No, you have to get work authorization, it is its own thing, that's what it is.
But going back to these fake foreign professionals, if we really want to shore up and to mitigate or at least forestall or to turn around the trend of the erosion of the rule of law in this country, let's go after the fake professionals because they are the ones that are purporting to represent people before the law. They are purporting to be men who are committed to the law, and they are anything but. In fact, they are the antithesis of that; they are con men and charlatans parading as law men who are causing all sorts of untold damage to the public here in Thailand.
So I hope officials will take this seriously here in Thailand. I hope this article from the Bangkok Post marks perhaps a sea change or a change in thinking on this issue, and we actually see these fake foreign professionals “so-called”, be put back in their place which in my opinion in some cases, maybe jail.
